Enforcing arbitral awards in Latin America  

Our seminar, which is presented in collaboration with litigation funder Omni Bridgeway, will discuss the challenges and opportunities that arise when parties attempt to enforce arbitral awards in Latin America. In doing so, our speakers will consider the strategies that can be employed in cases against sovereign and non-sovereign parties while considering the possible defences that may arise in the context of the enforcement of arbitral awards in Latin America.

Speakers

Erika Levin

Erika is a Partner at Fox Rothschild LLP and focuses her practice on international commercial arbitration and complex litigation as well as litigation finance. She advises clients within the financial, fashion, construction, energy, transportation, manufacturing, distribution, healthcare, insurance, and technology sectors. She is a Fellow of the Chartered Institute of Arbitrators and also serves as an arbitrator for many of the leading international arbitral institutions.

Born in Brazil, Erika has developed a network of contacts throughout the world. She represents financial institutions, private equity funds, hedge funds, pension funds, distressed funds and high-net-worth investors in a wide variety of matters. A significant part of her practice is dedicated to disputes and monetization opportunities relating to Brazil and Latin America.

Ricardo Ampuero Llerena

 

Ricardo Ampuero is a professor at Universidad Peruana de Ciencias Aplicadas (UPC) and works as an independent consultant. He served as President of the Special Commission that represents the Republic of Peru in International Investment Disputes. This Commission is in charge of coordinating the legal defense of the State in all stages of investor-State disputes that arise from international investment agreements and investment contracts. Previously, he has served as Legal Advisor and Technical Secretary of the Special Commission.

Ricardo has been a member of the Peruvian delegation in the Working Group of High Level Experts on Investment Dispute Settlement Mechanisms at UNASUR, as well as in UNCITRAL Working Group III on Possible Reform of the Investor-State Dispute Settlement System. He also served as representative of the Peruvian State for the process of amendments to the ICSID Rules and Regulations.

Ricardo holds a Law degree from UPC and a Master in Law (LL.M.) degree from Columbia University, New York, where he attended as a Fulbright scholar.

Wieger Wielinga 

Wieger is a Managing Director Enforcement & EMEA responsible for Omni Bridgeway’s investment origination in (sovereign) awards and judgments globally and its litigation funding efforts both in EMEA and the UK.

With close to three decades of experience in global litigation, litigation funding and enforcement, Wieger began his career in 1992 as an attorney at Loeff Claeys Verbeke (now Allen & Overy) specialising in litigation and insolvency matters. He has been an advising lawyer to the International Finance Corporation / World Bank on various emerging markets projects and has advised several multinationals on investments in former Soviet states.

Wieger holds an MBA from INSEAD, Fontainebleau, a Masters in Law from Leiden University and a post-doctorate degree in Insolvency Law from University of Nijmegen.
